FHA Condo Approvals – Question About Case Number Expiration

Here is a question that I have fielded many times regarding what happens when an FHA loan for a condominium is in process and the condo project’s approval with HUD is soon to expire.

[For those who are unfamiliar, when an FHA loan is initiated, a “case number” is generated which allows HUD to track the loan.]

Hey Eric, a quick question for you.  We have a case number for our borrower for a complex that is set to expire at the end of the month.  Do we need to close the loan before the fha approval expires or are we grandfathered in due to already having a case number?  Thank you for your time.

Here is my response:

Hi Bryan,

Once the case number expires, no new FHA loans may encumber any units in the project.  So, to answer your question, if your transaction does not close and fund by the expiration of the approval of the condominium project, you will have to wait until the project is recertified.  There is no grace period nor is there a timeframe where the case number is “grandfathered in”.

However, I know of at least one lender that will close the file if it is currently processing the recertification of the project through DELRAP if the project approval has expired.
